In November 2023, animal rescue donor Arlene Dean filed a class action federal RICO and charity fraud lawsuit against Rescue Dogs Rescue Soldiers (RDRS) and associated individuals. The lawsuit alleged that RDRS engaged in fraudulent activities, misusing donations intended for dog rescue operations for personal gain, including the acquisition of real estate by founder Elizabeth Keller.
Rescue Dogs Rescue Soldiers, based in Cherry Valley, New York, partners with the New York City Animal Care and Control shelter. Their mission is to rehabilitate stray dogs and train them as companions for disabled war veterans. The organization is a registered charity with the New York State Department of Corporations and actively solicits donations through its website and social media platforms.
Following the lawsuit's filing, Elizabeth Keller stated, "We've never been sued before, but the truth will come out."
Before the lawsuit, in August 2023, the Otsego County Sheriff's Office investigated the living conditions of animals at RDRS facilities. The initial assessment found the dogs healthy, though improvements to their living conditions were recommended. A subsequent follow-up confirmed that the necessary enhancements had been made, leading to the closure of the investigation in September 2023.
On December 25, 2023, the civil case initiated by Dean was voluntarily dismissed without prejudice. This dismissal indicates that the plaintiff withdrew the lawsuit, allowing future litigation on the same claims.
Despite the legal challenges, Rescue Dogs Rescue Soldiers continues its mission to support both rescue dogs and veterans.
